The Arms Export Control Act requires that all manufacturers, exporters, temporary importers, and brokers of defense articles (including technical data) as defined on the United States Munitions List and furnishers of defense services are required to register with the Directorate of Defense Trade Controls (DDTC).

Under U.S. export regulations, every product/item is classified as being subject to the ITAR, the CCL, DOE or else is designated as EAR99.

There are plenty of examples of products that are not clearly identified under the USML and/or CCL and may require a formal Commodity Jurisidiction per 120.4 of the ITAR submitted to DDTC. The commodity jurisdiction procedure is used if doubt exists as to whether an article or service is covered by the USML. It may also be used for consideration of a redesignation of an article or service currently covered by the USML.
